Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of Markaloud ("the Service"), operated by Otherworld Dev ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
Markaloud is a transcription and feedback tool designed for academic use in higher education. The Service transcribes audio recordings of verbal feedback and uses AI to structure that feedback against rubrics.
2. Eligibility
The Service is intended for use by academic staff, teaching assistants, and other authorised personnel at higher education institutions. You must be at least 18 years old and have the authority to agree to these Terms on behalf of yourself or your institution.
3. Account Registration
You must provide a valid email address and verify it before using the Service. You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@markaloud.cloud if you suspect unauthorised access to your account.
4. Acceptable Use
You agree to use the Service only for lawful academic purposes. You must not:
- Upload content that is unlawful, defamatory, or infringes third-party rights
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Use the Service to process data unrelated to academic feedback
- Share your account credentials or allow unauthorised access
- Attempt to circumvent usage limits, rate limits, or security measures
- Use automated tools to scrape, crawl, or extract data from the Service
5. Credits and Payments
Individual users purchase credit packs to use the Service. Credits are measured in transcription minutes and are deducted based on the duration of audio processed. Credits do not expire. All purchases are non-refundable except where required by law or at our discretion.
Institutional customers are billed under separate agreements with annual platform fees and per-minute usage charges. Payment terms are specified in the institutional contract.
6. Intellectual Property
You retain ownership of all audio recordings, transcripts, and feedback content you create using the Service. We do not claim any intellectual property rights over your content.
The Service, including its design, code, and branding, is owned by Otherworld Dev. You may not copy, modify, or distribute any part of the Service without written permission.
7. AI-Generated Content
The Service uses AI (OpenAI Whisper for transcription, Anthropic Claude for feedback structuring) to process your audio. AI-generated output is provided as a draft for your review and editing. You are solely responsible for reviewing, editing, and approving all feedback before sharing it with students.
We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. Academic judgement remains your responsibility.
8. Data Processing
We process personal data in accordance with our Privacy Policy. Audio recordings are transmitted to third-party AI providers (OpenAI and Anthropic) for processing. Neither provider uses your data to train their models. Full details of our data handling are available in our Data Processing Agreement.
9. Service Availability
We aim to provide reliable access to the Service but do not guarantee uninterrupted availability. We may perform maintenance, updates, or modifications that temporarily affect access. We will endeavour to provide reasonable notice of planned downtime.
10. Account Suspension and Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or pose a security risk. You may delete your account at any time from the Settings page, which permanently removes all your data.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.
We are not responsible for any academic decisions made based on AI-generated feedback, nor for any consequences arising from the use of that feedback.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales.
